DISPOSITIVO En consecuencia, ESTE TRIBUNAL SEGUNDO DE PRIMERA INSTANCIA EN FUNCION DE CONTROL DEL CIRCUITO JUDICIAL PENAL DEL ESTADO TACHIRA, ADMINISTRANDO JUSTICIA EN NOMBRE DE LA REPUBLICA BOLIVARIANA DE VENEZUELA Y POR AUTORIDAD DE LA LEY, decide: PRIMERO: NIEGA LA ENTREGA del vehículo MARCA: YAMAHA; MODELO: YZ-500, PLACAS: SIN PLACAS; SERIAL DE CHASIS: 26001998; SERIAL DE MOTOR ZDL162FMJ6200523, COLOR: NEGRO Y GRIS, CLASE: MOTOCICLETA; USO PARTICULAR; al Ciudadano RAFAEL ANTONIO VALECILLOS HERNÁNDEZ, Venezolano, mayor de edad, titular de la cédula de identidad N° V- 12.705.421, por cuanto no existen en las presentes actuaciones, instrumento legal, que éste ciudadano demuestre ser propietario del vehículo (moto) antes identificado; e insta al Ministerio Público a realizar las correspondientes investigaciones en base a los argumentos anteriormente enunciados, que dieron origen a la negativa de entrega de vehículo del presente Asunto.
